These Terms of Use (the "Terms") apply to your use of TooLab.io at toolab.io (the "Site"), which is operated by TooLab.io ("we", "us"). By using the Site you agree to these Terms, to our Privacy Policy and to our Cookie Policy. If you do not agree, please do not use the Site.
1. The service
TooLab.io lets you check your computer's hardware and browser in the browser itself: keyboard, mouse, touch screen, camera, microphone, speakers, display, game controllers and system details. It also offers tools and apps, such as a photo editor, an audio editor and a QR code generator, and a blog. The tests and tools run on your device. We may add, change or remove features at any time.
2. Who may use the Site
You must be at least 13 years old to use the Site. If you are under the age of majority where you live, use the Site only with the permission of a parent or guardian. If you use the Site on behalf of an organization, you confirm that you are allowed to accept these Terms for it.
3. Accounts, registration and sign-in
Some features, such as the dashboard, need you to sign in with your Google account. Google's own terms apply to your Google account. When you sign in:
- use only your own Google account;
- keep your Google account secure and do not share access to it;
- you are responsible for what happens under your account;
- tell us right away at info@toolab.io if you think someone else has used it.
Signing in uses cookies that keep you signed in and protect your account (see the Cookie Policy). We may suspend or close an account that breaks these Terms or puts the Site or other people at risk. You can ask us to close your account at any time.
4. Acceptable use
You agree not to:
- use the Site in a way that breaks the law or anyone's rights;
- try to get unauthorized access to the Site, its servers or other people's accounts;
- disrupt the Site, for example by overloading it or spreading malware;
- copy, scrape or resell the Site or its content in bulk, or access it by automated means other than standard search engine crawlers;
- use the Site to collect information about other people;
- remove or hide any copyright, trademark or legal notice.
5. Camera, microphone and device access
Some tests ask your browser for permission to use your camera, microphone or other devices. You decide whether to allow it, and you can withdraw permission in your browser settings at any time. Video, sound and input from these tests are processed on your device and are not sent to us. Photos and recordings you make in a test stay in your browser until you close it, unless you save them yourself.
6. Health and safety
Flashing light: the display test shows full-screen colors that change quickly. If you have photosensitive epilepsy or are sensitive to flashing light, do not use it.
The speaker test, tone generator and frequency sweep can produce loud and high-pitched sounds. Start with a low volume, especially with headphones, to protect your hearing and your equipment. More details are in the Legal Disclaimer.
7. Intellectual property
The Site, including its design, code, text and graphics, belongs to TooLab.io or its licensors and is protected by law. You may use the Site for personal use or for your organization's internal use, and you may link to any page of it. Any other use needs our written permission.
Names of products, browsers and companies mentioned on the Site are trademarks of their owners. We are not affiliated with them or endorsed by them.
8. Third-party services and links
The Site uses services from other companies, such as Google sign-in, Google Analytics and Cloudflare, and may link to other websites. Their own terms and privacy policies apply to them, and we are not responsible for their content or practices. See the Privacy Policy for the services we use.
9. Availability and changes to the Site
We provide the Site "as is" and "as available". We may change, suspend or stop any part of it at any time. We do not promise that it will be uninterrupted, free of errors, or work on every device, browser or in every country.
10. Disclaimer and limitation of liability
Test results depend on your browser, operating system, drivers and settings, and are for general information only. They are not a guarantee about the condition of any device. The Legal Disclaimer explains this in more detail and is part of these Terms.
To the fullest extent the law allows, TooLab.io will not be liable for indirect, incidental, special or consequential damages, or for loss of data, profits or equipment, that result from using the Site or relying on its results. Our total liability for any claim about the Site is limited to the amount you paid us to use it in the 12 months before the claim, or USD 50 if you paid nothing. Some laws do not allow these limits, so they apply only as far as the law permits.
11. Indemnity
You agree to compensate TooLab.io for claims, damages and costs, including reasonable legal fees, that result from your breach of these Terms or your misuse of the Site.
12. Changes to these Terms
We may update these Terms. The "Last updated" date at the top shows when they last changed. If a change is significant, we will make reasonable efforts to let you know, for example with a notice on the Site. If you keep using the Site after a change, you accept the updated Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of Israel, without regard to conflict-of-law rules. The competent courts in Tel Aviv-Jaffa, Israel have exclusive jurisdiction over any dispute about the Site or these Terms, unless the mandatory law of the country where you live gives you the right to go to court there.
14. General
If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a right, that does not mean we give it up. These Terms, together with the policies they mention, are the entire agreement between you and us about the Site.
